CanBuildOS Terms of Service
Version 1.4 · Effective October 24, 2026.
1. About these terms
CanBuildOS is an online service for running construction projects: tracking costs against budgets, preparing estimates and invoices, keeping client and supplier records, storing project documents, and managing owner-builder projects. It is operated by Joomberry Canada Ltd. ("Joomberry", "we", "us").
These terms apply to everyone who uses CanBuildOS. Sections 1 to 11 and 13 to 19 apply to all users. Section 12 adds terms for homeowners who use the client portal. By creating an account, accepting an invitation, or using CanBuildOS, you agree to these terms.
2. Accounts and security
- Give accurate information when you create your account, and keep it up to date.
- Keep your password private. Each account is for one person; don't share it.
- Some roles must use two-factor authentication, including company owners, consultants on owner-builder projects and our platform administrators. We may extend this to other roles.
- You are responsible for activity on your account. Tell us at hello@canbuildos.com straight away if you think someone else has used it.
3. Workspaces, owners and members
Each business or project uses a workspace. The workspace owner decides who joins, which role each member has and what each role can do. The owner is responsible for the members they invite and for how those members use the workspace.
A workspace can contain one or more legal entities (for example, an operating company). The workspace owner confirms they are authorized to act for each legal entity they add.
4. Your content
"Your content" means everything you or your members put into CanBuildOS: company details, clients and contacts, suppliers, estimates, invoices, costs and payments, notes, documents and photos.
- You keep ownership of your content.
- You give us permission to store, process, copy and display your content only as needed to run CanBuildOS for you, keep it secure, and meet our legal obligations.
- You confirm you have the right to upload your content, including personal information about your clients, suppliers and trades, and that you will handle that information in line with Canadian privacy law.
- For personal information in your workspace, we act on your instructions. Our Privacy Policy explains this in more detail.
5. Acceptable use
You must not:
- use CanBuildOS for anything unlawful, fraudulent or misleading;
- try to access another workspace, another person's account, or any part of CanBuildOS you have not been given access to;
- upload malware, or files you know are harmful;
- probe, scan or test CanBuildOS for vulnerabilities without our written permission, or interfere with its operation;
- copy, scrape, resell or build a competing product from CanBuildOS;
- upload content you don't have the right to share.
6. Documents and files
Uploaded files are scanned for malware before they become available. A file that fails the scan, or cannot be scanned, may be blocked. Keep your own copies of important documents; CanBuildOS is not a backup service.
7. What CanBuildOS is not
- Not professional advice. CanBuildOS organizes the information you enter. It does not give accounting, tax, legal, engineering, permitting or building-code advice. You are responsible for the figures you enter and for checking any totals, taxes and reports before you rely on them.
- Not a payment processor. CanBuildOS records payments that people tell it about. It does not move money, hold funds, or confirm that a payment was made.
- Not a party to your contracts. Your agreements with clients, homeowners, trades and suppliers are between you and them.
8. Owner-builder mode and consultants
In owner-builder mode, a homeowner manages their own build and may invite a consultant to advise them. Advice, recommendations and answers from a consultant are the consultant's own. Joomberry does not provide them, check them, or verify any consultant's qualifications or licences. The owner-builder remains responsible for their project, including permits, inspections, building-code compliance, insurance and any statutory or warranty obligations.
9. Fees
CanBuildOS is currently provided free of charge during early access.
We will give workspace owners at least 30 days' notice by email before we start charging, or change prices. Fees do not include applicable taxes.
10. Availability and changes
We work to keep CanBuildOS available and secure, but we can't promise it will be uninterrupted or error-free. We may carry out maintenance, and we may add, change or remove features. If we remove a feature you rely on, we will tell workspace owners in advance where we reasonably can.
11. Suspension and closing an account
- We may suspend a workspace or account if these terms are broken, if we need to protect CanBuildOS or other users, if required by law, or if fees are unpaid. Where it is safe and lawful to do so, we will tell the workspace owner why.
- Suspension does not delete your content. When a workspace is suspended, its members can't sign in until it is reactivated.
- A workspace owner may close the workspace at any time by contacting us. We will keep the workspace's content for 90 days after closure so you can request an export, then delete it as described in our Privacy Policy.
12. Homeowners using the client portal
This section applies to homeowners and other clients who use the CanBuildOS client portal at client.canbuildos.com.
- Access by invitation. Your contractor invites you. You create your own password. Your contractor never sees, sets or resets your password, and cannot sign in as you.
- What you can see. You see the information your contractor chooses to share with you about your project, such as estimates and invoices.
- Payments you report. If you tell the portal you paid a trade directly, that report is a record only. Your contractor checks it with the trade and records it as a full or part payment. Joomberry does not process, verify or guarantee any payment.
- Your contract is with your contractor. Joomberry is not part of your agreement with your contractor or any trade. We are not responsible for the work, prices, schedules, quality or any dispute about them.
- Ending access. Your contractor can remove your portal access at any time, and you can stop using the portal at any time. The project records belong to your contractor's workspace. Our Privacy Policy explains what happens to your own account information.
13. Our property
CanBuildOS, its software, design and name belong to Joomberry. These terms give you the right to use CanBuildOS; they don't transfer any ownership. If you send us suggestions, we may use them without obligation to you.
14. Disclaimers
To the extent the law allows, CanBuildOS is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose. Some laws don't allow these exclusions; where they apply, they apply only as far as the law requires.
15. Limits on our liability
To the extent the law allows:
- Joomberry is not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data, arising from your use of CanBuildOS;
- Joomberry's total liability for all claims relating to CanBuildOS is limited to the greater of the fees you paid us in the 12 months before the claim and CAD $100.
Nothing in these terms limits liability that cannot be limited under applicable law.
16. Your responsibility to us
Workspace owners agree to cover Joomberry's reasonable losses and costs arising from claims by others about content in their workspace, or about their or their members' breach of these terms or of the law.
17. Changes to these terms
We may update these terms. For a significant change, we will give at least 30 days' notice by email or in CanBuildOS before it takes effect. Each version has a version number, and CanBuildOS records which version you accepted and when. If you keep using CanBuildOS after a change takes effect, you accept the new version.
18. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction over any dispute about them.
